Introduction
This document contains the general commercial terms and conditions ("Terms") governing all sales and deliveries of products between Gima (UK) LTD ("Gima" or the "Company") and its customers ("Customer")
Order Placement
Orders are placed on the website by placing an order with Gima; the customers acknowledge and accept these Terms and Conditions by ticking the checkbox
Prices and Payment
All prices are in pounds sterling and exclude VAT. Payment must be made in advance before the delivery of the order. In case of late and non payments, Gima reserves the right to cancel the orders or demand interest the Bank of the England base rate +3%. Gima reserves the right to conduct a credit check before the delivery of the order.
Delivery
Delivery will be made from Gima's warehouse to the Customer's delivery address. The delivery time is 3-5 working days after order confirmation. Gima reserves the right to cancel or the order change the delivery time depending on stock availability or unforeseen delays. The Customer is responsible for inspecting the goods upon delivery and must immediately notify Gima of any damages or shortages.
Cancellation and Returns
The customer may cancel the order up to 24 hours before delivery. Gima May cancel the order at anytime with or without notice and if notified with 1 hour of delivery. Delivered products can be returned only if faulty or damaged. Returned products must be returned to Gima in their original packaging with the invoice. Gima will refund the value of the returned products to the Customer after deducting delivery and handling costs.
Risk & Ownership
All risks in the products pass to the customer on delivery. Ownership of the products shall remain with the company until the products are paid for in full.
Liability
Gima guarantees the merchantability and fitness for a particular purpose of the goods. Gima shall not be liable for incidental or consequential damages. Gima's total liability is limited to the total value of the order.
Dispute Resolution
Any dispute arising from these Terms shall be resolved in accordance with the laws of England and Wales. Any dispute shall be resolved in the competent courts of London.
Other Provisions
These Terms supersede all agreements between Gima and the Customer. Gima reserves the right to amend these Terms at any time. In the event that any provision of these Terms is invalid, the remaining provisions shall remain in full force and effect.
